Intellectual property and restrictions on use of content

Peak Peak Online Business Advisers reserves its right to edit, refuse to post or to remove any information and/or materials (in whole or in part) that in Peak Online Business Advisers' sole discretion is in any way objectionable or in violation of any applicable law or the Terms and Conditions. User license to Peak Online Business Advisers

By placing any information or other material on This Site (including posting messages, uploading files, inputting data or engaging in any other form of communication), you grant to Peak Online Business Advisers a perpetual, royalty-free, non-exclusive, irrevocable, unrestricted, worldwide license to do the following in respect of the information or material:

• the payment of the cost of having services supplied again; and

In the case of goods supplied or offered by Peak Online Business Advisers;

• the replacement of the goods or the supply of equivalent goods;
• the repair of such goods;
• the payment of the cost of replacing the goods or acquiring equivalent goods; or
• the payment of the cost of having the goods repaired.

'Make An Offer' facility

Peak Online Business Advisers may from time to time offer a unique facility for placing an offer for goods advertised via The Site (the “Make An Offer Facility”). While we will endeavour to obtain goods at the price you offer, using the Make An Offer Facility does not in any way guarantee that you will get the goods at that price. All offers for goods advertised via The Site are always subject to stock availability and market price variations. Finally, usage of the Make An Offer Facility does not enforce or imply any type of contract, bid or quote for goods has been made.

Termination

The Terms and Conditions are effective until terminated by Peak Online Business Advisers, and Peak Online Business Advisers may terminate this agreement and your access to This Site at any time without notice. In the event of termination, you are no longer authorized to access This Site, but all restrictions imposed on you, licenses granted by you and all Peak Online Business Advisers disclaimers and limitations of liability set out in the Terms and Conditions will survive.

Peak Online Business Advisers relies on your continued observance of these Terms and Conditions. If Peak Online Business Advisers suffers any loss or damage or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation then you agree to indemnify Peak Online Business Advisers for those losses, damages and costs.

This agreement will be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement, which will continue in full force and effect.
